US Judge Mandates Release of Kilmar Abrego Garcia from ICE Detention
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement is without legal authority.
"Since his return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her ruling.
The situation stems from a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an error. After his repatriation to the United States to face alien smuggling allegations, he was detained in immigration custody.
In her order, the judge pointed out that the authorities does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

The legal challenge involve conflicting assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this allegation.
